1. Agreement to these terms
By accessing or using https://finddevs.com.au (the "Service"), submitting a brief, joining our developer network, or otherwise interacting with FindDevs, you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please stop using the Service.
These Terms form a binding contract between you and FindDevs Pty Ltd ("FindDevs", "we", "us", "our").
2. Who can use FindDevs
You may only use the Service if:
- You are at least 18 years old (or the age of majority where you live, if higher).
- You have the legal capacity to enter into a contract.
- You are using the Service for lawful purposes and in compliance with these Terms.
- If you're using the Service on behalf of a business, you have authority to bind that business.
3. What FindDevs is, and isn't
What we do. FindDevs is a referral and matchmaking network. When you submit a project brief, we use it to identify up to three Australian developers in our network who appear to be a good fit, and we share your brief with them so they can prepare a quote.
What we don't do. FindDevs does not perform development work directly. We are not a party to the contract you eventually sign with a developer, we do not employ the developers in our network, and we make no guarantee that any particular developer will respond, quote, or deliver any specific outcome.
The Service Guarantee. We offer a Service Guarantee that if a matched developer fails to perform, we'll work with you to find a replacement. The Service Guarantee is described on our home page and is offered at our discretion as a goodwill measure. It does not create any contractual obligation on FindDevs to deliver development services.
4. Terms for clients (people requesting quotes)
4.1 Cost
Submitting a brief and receiving up to three quotes is free. There is no subscription, no commission added to your developer's price, and no upsell.
4.2 Honest briefs
You agree to provide accurate information about your project, budget, and timeline. Briefs that are deliberately false, misleading, or that exist to phish or scrape developer information will be removed and may result in a permanent ban.
4.3 Engaging a developer
If you engage a developer you found through FindDevs, the contract you form is solely between you and that developer. We strongly recommend you sign a written agreement covering scope, payment, IP, confidentiality, and dispute resolution before work begins.
4.4 Going around us
For 12 months from the date of introduction, you agree not to engage a developer FindDevs has matched you with through any channel that bypasses FindDevs purely to avoid the developer's referral fee to us. Engaging the same developer for unrelated work, after the 12-month period, or via existing prior relationships is fine.
5. Terms for developers (network members)
5.1 Application and vetting
Joining the FindDevs network is by application. We review portfolios, technical skill, communication, and Australian client references. We may accept or reject applications at our discretion, and we may remove members from the network at any time for cause.
5.2 Referral fee
Network developers agree to pay FindDevs a referral fee on work won through the network, calculated as a percentage of the contract value. The current rate, payment schedule, and method are set out in the separate Developer Network Agreement signed at onboarding.
5.3 Quote quality and turnaround
You agree to respond to matched briefs within the published service-level (currently 24 hours), to provide written quotes that accurately reflect scope and price, and to communicate professionally with clients regardless of whether you win the work.
5.4 Confidentiality
You agree to treat all client briefs as confidential. You may not use a brief for any purpose other than preparing a quote, you may not add the client to a marketing list, and you may not share the brief with anyone outside your immediate quoting team.
5.5 Vetted, not endorsed
FindDevs vetting is a quality screen, not a guarantee of any specific outcome. Membership in the network does not constitute an endorsement, employment, or partnership.
6. Acceptable use
You agree not to use the Service to:
- Break any Australian or international law.
- Infringe anyone's intellectual property, privacy, or other rights.
- Submit content that is unlawful, defamatory, harassing, threatening, hateful, or pornographic.
- Attempt to reverse engineer, scrape, mirror, or systematically copy the Service or its content.
- Probe, scan, or test the vulnerability of any FindDevs system without our prior written consent.
- Interfere with or disrupt the Service, its security, or any other user's use of it.
- Impersonate any person, business, or entity.
- Use the Service to send unsolicited marketing.
7. Intellectual property
7.1 Our content
The FindDevs name, logo, design, copy, illustrations, code, and the structure of the Service are owned by FindDevs Pty Ltd or our licensors and are protected by Australian and international intellectual-property law. You may not copy, modify, distribute, or create derivative works of any of it without our prior written consent.
7.2 Your content
When you submit a brief or other content to the Service, you keep ownership of it. You grant FindDevs a non-exclusive, royalty-free licence to host, store, reproduce, and share that content with matched developers for the purpose of providing the Service.
7.3 Feedback
If you send us feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, royalty-free licence to use them without obligation to you.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defect will be corrected. We do not warrant the quality, suitability, legality, or outcome of any work you engage a developer to perform.
Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer right or guarantee under the Australian Consumer Law that cannot be lawfully excluded. Where a guarantee under the Australian Consumer Law applies and cannot be excluded, our liability is limited (where permitted) to re-supplying the Service or paying the cost of having it re-supplied.
9. Limitation of liability
To the maximum extent permitted by law:
- FindDevs is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business opportunity, or goodwill, arising out of your use of the Service.
- Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service is capped at AUD $100, or the total fees you have paid us in the 12 months immediately preceding the claim, whichever is greater.
- FindDevs is not responsible for the acts or omissions of any developer in the network. Disputes about scope, payment, quality, or delivery of development work are between you and the developer.
10. Indemnity
You agree to indemnify and hold harmless FindDevs and our directors, employees, contractors, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of:
- Your breach of these Terms;
- Your breach of any law or third-party right;
- Any content you submit to the Service; or
- Any contract you enter into with a developer found through the Service.
11. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, threatened the integrity of the Service, or failed to pay fees owed (developers).
You may stop using the Service at any time. The provisions of these Terms that by their nature should survive termination (including IP, disclaimers, liability, indemnity, and governing law) will continue to apply.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email (if we have one for you) and post an updated copy with a new "Last updated" date at the top of this page at least 14 days before the change takes effect. Your continued use of the Service after that date means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. You and FindDevs submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising out of these Terms.

14. General
- Entire agreement. These Terms, together with our Privacy Policy and any agreement we sign separately with you, are the entire agreement between us about the Service.
- Severability. If any part of these Terms is held to be unenforceable, the rest remain in force.
- No waiver. If we don't enforce a right, that doesn't mean we've given it up.
- Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours in the context of a sale, merger, or restructure.
- Notices. We'll send you notices by email or by posting them on the Service. You can send us notices at hello@finddevs.com.au.
